The Services provide access to educational content, wellness programs, and connections to independent licensed medical providers and third-party pharmacies.

Relationship with Providers & Third Parties

NSIFit Wellness:

Does not practice medicine

Does not control medical decisions

Does not operate pharmacies

Independent licensed providers (“Providers”) are solely responsible for:

Diagnosis

Treatment

Prescriptions

Pharmacies are solely responsible for medication fulfillment.

Use of the Services does not create a doctor-patient relationship with NSIFit Wellness, but may create one with a Provider.

Provider Communications

Providers may contact you via:

SMS

You are responsible for monitoring and responding to communications.

NSIFit Wellness is not responsible for missed communications or outcomes resulting from failure to respond.

Subscriptions & Billing

Certain services are offered on a recurring subscription basis.

By subscribing, you authorize NSIFit Wellness to charge your payment method automatically.

Subscriptions renew automatically

You must cancel at least 72 hours before renewal

Cancellation takes effect at the end of the current billing cycle

Cancellation & Refund Limitations

Cancellation requests must be submitted prior to renewal

If canceled after payment but before fulfillment, a $99 administrative fee may apply

Once medication is processed or shipped, no refunds are available

You remain responsible for any active billing cycle

Minimum Terms & Payment Plans

If your program includes a minimum commitment (e.g., 3 months):

You are responsible for the full term

Canceling early does not eliminate financial responsibility

If using installment payments:

You remain responsible for the full balance

Required Documentation

You may be required to submit:

ID verification

Medical forms

Photos or videos

Delays in submission may delay service, but do not pause payment obligations.

Financial Responsibility Notice

All services are cash-pay.

NSIFit Wellness does not bill:

Medicare

Medicaid

Insurance providers

You are fully responsible for all costs.

Payment Default Policy

If payment fails:

We may retry charges

A $30 late fee may apply

Accounts may be suspended

After 30 days:

Accounts may be sent to collections

Additional fees may apply

Telehealth Consent

Services may include telehealth.

By using the platform, you agree to:

Receive care remotely

Accept associated risks

Complete required telehealth consent forms

User Responsibilities

You are responsible for:

Providing accurate information

Maintaining internet/device access

Paying all applicable fees

Protected Health Information

NSIFit Wellness is not a direct healthcare provider.

Providers and pharmacies may be subject to HIPAA

NSIFit may act as a business associate where applicable

Some data may be considered Protected Health Information (PHI), while other data is governed by the Privacy Policy.

Jurisdiction

These Terms are governed by the laws of the State of California and applicable U.S. law.

Arbitration & Dispute Resolution

All disputes must be resolved through binding arbitration administered by the American Arbitration Association (AAA).

No jury trials

No class actions

California Civil Code §1542 Waiver

By agreeing to these Terms, you waive rights under California Civil Code §1542 regarding unknown claims.
